This NameOptions.com Terms of Service ("TOS") will govern the terms and conditions for operating the website at www.nameoptions.com (the site and/or services). YOU AGREE THAT BY USING THE SITE AND/OR SERVICES YOU REPRESENT THAT YOU ARE AT LEAST EIGHTEEN (18) YEARS OLD AND THAT YOU ARE LEGALLY ABLE TO ENTER INTO THIS AGREEMENT. IF YOU ARE REGISTERING ON BEHALF OF A BUSINESS ENTITY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND THE ENTITY TO THIS AGREEMENT.

REFUNDS

Refunds will be issued in the event that a domain becomes unavailable in the course of the purchase. A refund may also be considered in extreme situations where the domain has not yet been transferred or pushed to the buyer's account at the registrar of record. However all sales are final.

AVAILABILITY

All efforts are made to ensure that domains are available if they are listed in the marketplace. We cannot guarantee 100% that a particular domain is available at the time an offer is made. If an offer for a domain is accepted then this indicates it is still available and we are bound to sell it to the party whose offer has been accepted. If a counter-offer has not been accepted then the domain is open to be sold to another interested party.

MINIMUM OFFERS

All domains have a minimum offer amount. When an offer is entered into the offer field, a minimum amount will be displayed. The minimum offer does not indicate the price of the domain. To ensure the best chance of acquiring a desired domain and quickly, it is recommended you enter the highest amount you are able to pay for the domain. In most cases the minimum offer amount will be countered. The minimum offer is more likely to be accepted for domain lease/rent or monthly payments (lease to own).

CONTRACTUAL OBLIGATIONS

When you enter an offer for a domain, you are contractually bound to pay that amount for that specific domain in the currency indicated. If your offer is accepted, Name Options is contractually bound to transfer the domain after payment is made. In the event a counter-offer is made, you are free from the binding original offer. Once the final price is agreed on, both parties are contractually obligated to fulfill their mutual agreement.

THIRD PARTY DOMAIN LISTINGS

Name Options includes domain listings from third parties. Name Options is not responsible for the sale of those domains. We simply provide a service that allows buyers to know what domains are available and where they can be purchased. A link is provided to external domain marketplace websites where the purchase can be fulfilled. The terms and conditions of third party marketplaces should be consulted. Name Options is not responsible or involved in those sales.
